Emergency Meeting Concerning BCSS Lawsuit
POA Emergency Board Meeting - called to order at 9 a.m.
Board members: Dick Dayton, Kathy Menk, Ann Bacher, Mitzi Alemond. DeAnn Gardner via phone call to Dick Dayton.
The ruling of the judge concerning the lawsuit with Baldwin County Sewer Service was reviewed with the board members. The ruling allows BCSS to increase sewage rates.
The judge’s ruling can be accepted and the 1991 BCSS contract is nullified.
An appeal to the Alabama Supreme Court can be initiated.
If the appeal is initiated, the attorney will write a brief contesting the ruling. This brief will have an initial cost of $5,000 to $10,000. The cost will be prorated with all neighborhoods that approve the Appeal.
The following facts were considered by the board members:
There has already been a significant investment in this lawsuit.
The increase in rates will cause a hardship on residents who are on a fixed income.
Currently, Lake View Estates has sufficient funds to pursue the appeal.
The sewer rate for Glenlakes is already significant compared to the sewer rates of the other cities in the area.
The Lake View Estates Board unanimously voted to appeal the ruling to the Alabama State Supreme Court.
